RULES OF CONDUCT FOR USERS OF SKI AREAS
Art. 8 (Obligation to use a protective ski helmet for children under 14 years of age)
When alpine skiing or snowboarding children under fourteen years of age are obliged to wear a protective ski helmet that conforms to the characteristics as set out in paragraph 3.
Anyone breaching the provisions as per paragraph 1 shall be obliged to pay a fine of between € 30 and € 150.
Within three months from the date this law enters into force, the Minister of Health, acting jointly with the Minister of Infrastructure and Transport, having received the opinions of the relevant body of CONI (the Italian National Olympic Committee), shall establish, by decree, the technical characteristics of the protective helmets as per paragraph 1, and shall establish the methods for approval, assessment of production conformity and appropriate controls.
Any person or entity that imports or produces for trade protective ski helmets of a type not conforming to the characteristics as per paragraph 3 shall be obliged to pay a fine of from € 5,000 to € 100,000.
Any person or entity that trades protective ski helmets of a type not conforming to the characteristics as per paragraph 3 shall be obliged to pay a fine of from € 500 to € 5,000.
The protective ski helmets that do not conform to the prescribed characteristics shall be subject to seizure on the part of the legal authorities.
The provisions as per paragraphs 1, 2, 4, 5 and 6 take effect as from 1st January 2005.
